Terms of Service

Important: Please read these terms carefully before using F3C. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Introduction and Acceptance

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and F3C ("we," "us," or "our") governing your access to and use of the F3C service, including our website, applications, and API (collectively, the "Service").

You may not transfer outside the Services any software (including related documentation) you obtain from us or third party licensors in connection with the Services without specific authorization to do so.

By creating an account, accessing the Service, or clicking to accept these Terms, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.


2. Definitions

"API"
means the application programming interface provided by F3C for programmatic access to the Service.
"API Credentials"
means the unique keys, tokens, or other authentication mechanisms issued to access the API.
"Customer"
means the individual or entity responsible for payment and account administration.
"Data"
means information retrieved from the Service, including FCC licensing data, USGS data, and any derived or aggregated information.
"Subscription Tier"
means the level of service selected by Customer (Free, Non-Commercial, Commercial, or Enterprise).
"User"
means any individual who accesses or uses the Service under a Customer account.

3. Service Description and Subscription Tiers

3.1 Service Overview

F3C provides access to a database containing information derived from the Federal Communications Commission (FCC) Universal Licensing System (ULS) and the United States Geological Survey (USGS). The Service allows Users to search, retrieve, and analyze licensing and geographic data through a web interface and, for eligible tiers, an API.

From time to time, we may apply upgrades, patches, bug fixes, or other maintenance to the Services ("Maintenance"). We agree to use reasonable efforts to provide you with prior notice of any scheduled Maintenance (except for emergency Maintenance), and you agree to use reasonable efforts to comply with any Maintenance requirements that we notify you about.

3.2 Subscription Tiers

(a) Free Tier

Limited to five (5) searches total. No API access. Intended for evaluation purposes only. No ongoing service obligation upon exhaustion of searches.

(b) Non-Commercial Tier

Web interface access with rate limits as specified in your account dashboard. Restricted to personal, educational, and hobbyist use. No commercial use or resale permitted. API access is not included.

(c) Commercial Tier

Web interface access to advanced features with rate limits as specified in your account dashboard. Permitted for business and commercial purposes.

(d) Enterprise Tier

Negotiated terms, rate limits, and features as specified in a separate agreement. Includes API access.


4. Government Data Sources and Attribution

4.1 FCC Data

Required Notice

This product uses the FCC Data API but is not endorsed or certified by the FCC.

Data provided through the Service is derived from the FCC Universal Licensing System. The underlying FCC data is in the public domain under 17 U.S.C. § 105. However, you acknowledge that: (i) FCC data may not constitute the complete record for any license; (ii) pending transactions, spectrum leasing arrangements, court actions, and other factors not reflected in the database may affect license status; and (iii) users seeking authoritative records should consult the FCC's official databases directly.

4.2 USGS Data

Credit: U.S. Geological Survey

Geographic and mapping data is sourced from the United States Geological Survey and is provided under public domain dedication (CC0). You acknowledge that: (i) USGS data may include "provisional" data subject to revision; (ii) certain imagery may be subject to third-party licensing restrictions; and (iii) emergency response data may require additional data access agreements.


5. Account Terms

5.1 Account Registration

To access the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5.2 Eligibility

You must be at least 18 years of age or the age of majority in your jurisdiction to use the Service. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

5.3 Account Security

You must immediately notify F3C of any unauthorized use of your account or any other security breach. F3C will not be liable for any loss or damage arising from your failure to protect your account credentials.

You will not, and will not allow any third-party to use F3C to, directly or indirectly, develop or improve a similar or competing product or service.


6. Subscription and Billing

6.1 Fees and Payment

Subscription fees are charged in advance on a monthly or annual basis as selected at sign-up. All fees are non-refundable except as expressly provided in these Terms or required by applicable law. We may change our fees upon thirty (30) days' notice.

6.2 Automatic Renewal

Your subscription will automatically renew

at the end of each billing period unless you cancel before the renewal date. You authorize us to charge your payment method on file for each renewal period at the then-current rate.

6.3 Cancellation

You may cancel your subscription at any time through your account settings or by contacting support. Cancellation will take effect at the end of your current billing period. You will retain access to the Service until the end of the period for which you have paid. Cancellation is as easy as signing up — no phone calls required.

6.4 Free Tier

The Free Tier is provided free of charge and is limited to five (5) total searches. Upon exhaustion of searches, your Free account will become inactive. Data and configurations from Free accounts are not retained and may be deleted at any time. The Free Tier creates no ongoing service obligation.


7. API Terms

This section applies only to Enterprise tier subscribers with API access.

7.1 API Credentials

F3C will issue API Credentials upon activation of an eligible subscription. All activities that occur using your API Credentials are your responsibility. You must: (i) keep your API Credentials confidential; (ii) not share, transfer, sell, or sublicense your API Credentials; and (iii) notify F3C immediately if you suspect any compromise of your API Credentials.

7.2 Rate Limits

F3C sets and enforces rate limits on API usage in our sole discretion. Current rate limits are published in our API documentation and your account dashboard. You agree to comply with these limits and will not attempt to circumvent them. Consequences for exceeding rate limits may include: throttling, temporary suspension, or termination for repeated violations.

7.3 API Changes and Deprecation

F3C reserves the right to modify, deprecate, or discontinue API features. We will provide at least twelve (12) months of support for each major API version: six (6) months as active and six (6) months as deprecated with limited support. Notice of deprecation will be provided through our developer channels and documentation.


8. Acceptable Use Policy

8.1 Permitted Use

You may use the Service and Data retrieved from it solely for your internal business purposes (Commercial/Enterprise tiers) or personal, educational, and hobbyist purposes (Non-Commercial tier) as applicable to your subscription.

8.2 Prohibited Conduct

You agree not to:

  • × Resell, redistribute, sublicense, or make Data available to third parties as a competing service
  • × Systematically download, scrape, or harvest Data to create a competing product or service
  • × Circumvent, disable, or interfere with rate limits, security features, or access controls
  • × Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
  • × Attempt to gain unauthorized access to any portion of the Service or related systems
  • × Transmit viruses, malware, or other harmful code
  • × Use the Non-Commercial tier for any commercial purpose

9. Intellectual Property

9.1 Government Data

The underlying FCC and USGS data are in the public domain and are not subject to copyright restrictions under United States law. You may use such data in accordance with applicable government data policies.

9.2 F3C Proprietary Rights

Notwithstanding the public domain status of underlying government data, F3C retains all rights in: (i) the F3C compilation, database structure, and organization; (ii) the F3C API, software, and technology; (iii) F3C trademarks, logos, and branding; (iv) documentation, user interfaces, and design elements; and (v) any value-added features, analytics, or derived products. These Terms do not grant you any rights in F3C's proprietary elements except the limited license to use the Service as expressly provided herein.


10. Data Accuracy and Timeliness

Important: Read This Section Carefully

Data provided through the Service is derived from government sources and is subject to the following limitations:

  • Lag Time: Data may be hours, days, or weeks behind official government databases depending on publication schedules and processing times.
  • Completeness: Data may not constitute the complete record for any license or geographic feature. Pending transactions, corrections, and updates may not be reflected.
  • Accuracy: Errors may exist in government source data or may be introduced during processing. F3C does not independently verify government data.
  • User Verification: You are solely responsible for verifying any Data before relying on it for legal, business, or regulatory decisions. Users seeking authoritative records should consult official government databases directly.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. F3C does not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

F3C makes no warranty regarding the accuracy, completeness, timeliness, or reliability of any data sourced from the FCC, USGS, or other government databases. F3C does not guarantee that data will be current or that errors will be corrected.

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you. In such jurisdictions, F3C's liability is limited to the maximum extent permitted by law.


12. Limitation of Liability

12.1 Exclusion of Damages

To the maximum extent permitted by law, in no event shall F3C, its affiliates, officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, arising out of or related to your use of or inability to use the Service, even if F3C has been advised of the possibility of such damages.

12.2 Liability Cap

To the maximum extent permitted by law, F3C's total cumulative liability shall not exceed:

Free Tier: Zero dollars ($0).
Non-Commercial Tier: The greater of (i) fifty dollars ($50) or (ii) the fees paid by you in the twelve (12) months preceding the claim.
Commercial Tier: The fees paid by you in the twelve (12) months preceding the claim.
Enterprise Tier: As specified in your separate agreement, or if not specified, the fees paid in the twelve (12) months preceding the claim.

12.3 Data-Specific Limitation

Without limiting the foregoing, F3C shall have no liability whatsoever for any damages arising from: (i) errors, omissions, or inaccuracies in Data; (ii) delays in Data updates from government sources; (iii) your reliance on Data without independent verification; or (iv) decisions made based on Data provided through the Service.


13. Indemnification

This section applies to Commercial and Enterprise tier subscribers only.

You agree to indemnify, defend, and hold harmless F3C and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (i) your use of the Service; (ii) your violation of these Terms; (iii) your violation of any applicable laws or regulations; or (iv) any third-party claims arising from your use of Data obtained through the Service.


14. Termination

14.1 Termination by You

You may terminate your account at any time by canceling your subscription through your account settings. Termination will be effective at the end of your current billing period.

14.2 Termination by F3C

F3C may suspend or terminate your access to the Service immediately and without notice if: (i) you breach these Terms; (ii) you fail to pay fees when due; (iii) we are required to do so by law; or (iv) we determine, in our sole discretion, that your use poses a security risk or may harm other users. For non-material breaches, F3C will provide thirty (30) days' notice and opportunity to cure before termination.

14.3 Effect of Termination

Upon termination: (i) your right to access the Service will immediately cease; (ii) you must immediately stop using any API Credentials; (iii) you must delete any cached or stored Data except as permitted by applicable law; and (iv) F3C may delete your account data after thirty (30) days. Sections 9 through 13, 15, and 16 shall survive termination.


15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware without regard to its conflict of law provisions.

15.2 Dispute Resolution — Commercial and Enterprise Tiers

For Commercial and Enterprise tier subscribers, any dispute arising out of or relating to these Terms shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. Judgment on the award may be entered in any court having jurisdiction.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

15.3 Dispute Resolution — Non-Commercial Tier

For Non-Commercial tier subscribers, disputes may be resolved in small claims court if eligible, or through binding arbitration as described above.


16. Modifications to Terms

F3C reserves the right to modify these Terms at any time. We will provide notice of material changes by: (i) posting the updated Terms on our website with a new "Last Updated" date; (ii) sending email notification to the address associated with your account; or (iii) providing in-app notification. Changes will be effective thirty (30) days after notice for existing users, or immediately for new users. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must cancel your subscription before the effective date.


17. General Provisions

17.1 Entire Agreement

These Terms, together with the Privacy Policy and any applicable order form or separate agreement, constitute the entire agreement between you and F3C regarding the Service.

17.2 Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17.3 Waiver

F3C's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

17.4 Assignment

You may not assign or transfer these Terms without F3C's prior written consent. F3C may assign these Terms in connection with a merger, acquisition, or sale of assets.
